First Question: "Is my tax debt correct?"

The tax profession employs thousands of people accross Australia primarily because of how large and complex tax laws are. So, if you think your tax debt is incorrect, or you don’t know if it is, don’t feel bad for feeling confused. 

The first question you should be asking yourself is: “Is my tax debt is correct”? If not, or if you don’t know, there are things you can do to have your tax reviewed. We’ve provided some general information below, but please feel free to contact us if you want more information, or representation.

       Reviewing your tax liability

  1. A practical starting spot is to determine whether you agree with the assessment reached by the Australian Taxation Office on your tax liability.

  2. If you think that your tax liability is incorrect, or you don’t know whether it is , it is sensible to have a tax professional review this for you before doing anything else.

  3. If, upon review, you and your tax professional determine that your tax liability is incorrect, then you may have rights to have that debt reviewed in a number of ways.

  4. The most common way to have your tax liabilty reviewed is to file an objection with the Australian Taxation Office under Part IV of the Taxation Administration Act 1953 (Cth) to have an independent department of the Australian Taxation Office review their previous decision.

  5. If this decision is favourable to you, then the Australian Taxation Office will amend your tax liability accordingly.

  6. If this decision is unfarouvable to you, then your tax liability will remain the same.

  7. However, if you still consider your tax liability to be incorrect, then you may have further rights to have that reviewed decision reviewed again, but by the Administrative Appeals Tribunal or Federal Court (ie, not by the Australian Taxation Office).
